Terms and Conditions of Use of ISG.ca Internet Hosting Services.


In order to provide our customers with a high quality Internet hosting service that is equitable for all, we have established some policies for its use.

By submitting a subscription application and subscribing to the ISG.ca Internet Hosting Services, you agree to abide by the following policies and procedures without any restrictions.

 

I.            The customer or authorized representative of the customer (if the customer is a company) certifies that he is 18 years of age or older.

II.          If the customer is a company, the contact person certifies he is an authorized representative of the company concerned.

III.       The customer agrees to use the Internet Hosting Services only for lawful purposes in accordance with the laws applicable in Canada and the country of the customer’s origin (according to the more severe of the laws between the two countries).

IV.        No adult content, pornography, content for pedophiles, racist groups, terrorists, hackers, or other content deemed illegal will be tolerated on the ISG.ca servers. The customer may be sued by ISG.ca and/or the authorities if he is found to be hosting content on the ISG.ca servers that is judged to be illegal.

V.          The customer agrees not to publish content on ISG.ca servers that violates copyright, trademark, or patent laws or other Canadian and international intellectual property rights. The customer states he is able to prove he owns the rights to the content published on his website.

VI.        The sending of unsolicited email (spam) sent through our system is strictly prohibited. A customer caught sending unsolicited email will have his account closed within 24 hours after the violation. Depending on the extent of the harm caused by his illegal actions, the customer could be prosecuted.

VII.            In the event that action is taken against ISG.ca regarding any illegal act carried out by the customer, the customer agrees to demonstrate and assert that he is solely responsible for his actions.

VIII.          The customer agrees not exceed the total bandwidth provided under the contract. If he exceeds the anticipated total, ISG.ca shall charge the customer according to the rates provided in the hosting plan (as defined on the ISG website. www.ISG.ca ca).

IX.        Payments are due by the customer upon receipt of an invoice. Late payment charges of 2% per month are payable. If payment is not received within 30 days following the invoice date, access to the FTP server will be interrupted until payment is received. The financial penalties mentioned in the invoice shall be applied. If payment is not received within 45 days following the billing date, the service will be completely interrupted without warning. If payment is returned by the bank with the words “without provisions,” a $25 fee will be imposed by ISG.ca. If the customer fails to pay, ISG.ca can delete all files on the server without notice and close the customer's account to allow another customer to use the disk space. If the customer wants to reactivate his account, a $40 fee will be charged to the customer in addition to any payment due from the past and not yet paid.

X.          When the customer chooses the monthly billing method, there is no fixed term contract. The contract continues until the customer sends a stop service request in writing to the address below. If the customer takes a 3, 6 or 12 month contract, the customer cannot cancel his contract or obtain a refund. Long-term contracts have the advantage of ensuring you do not receive any rate increase throughout the duration of the contract if you do not change the plan. In addition, the contracts give you a discount depending on the term chosen. The contract is automatically renewed at its maturity for another identical term. The customer will have 30 days from the date of receipt of the invoice to cancel the renewal. In order to not renew, the customer must make a request to the address below:

XI.        Hosting contracts are payable in advance for the entire term selected by the customer.

XII.            The customer agrees to keep his e-mail address active for the duration of his ISG.ca hosting plan. If the customer changes his email, he must notify ISG.ca by email as soon as possible.

XIII.          The customer agrees to make any address change in writing as soon as possible to the following address:

XIV.          Invoicing is done by ISG.ca in Canadian dollars. It is however possible to see the equivalent of our rates in U.S. dollars and in Euros on our website. The customer is responsible for providing the payment due within the time prescribed in this Agreement and on the invoice.

XV.      Even if the hosting account is not used, the customer agrees to pay the applicable monthly fee.

XVI.          The customer has 30 days from the opening of the hosting account to cancel the hosting plan and receive a full refund. Cancellation requests must be submitted in writing to the following address:

XVII.           The hosting plans provided by ISG.ca allow the use of CGI, ASP and other scripts.  Because these scripts use a lot of system resources, restrictions apply: The scripts must use acceptable system resources. Scripts that require a very large number of CPU cycles and a very large RAM memory space are prohibited. The scripts used shall in no way interact with the server configuration or hardware. Rotating banner systems other than for your own website are prohibited. Public metering systems and any other scripts that can be used on other websites are prohibited. Discussion scripts in Perl are prohibited.

XVIII.           Customers must use the SMTP server provided by their ISP to send their emails.

XIX.          Due to the instability of the Internet, ISG.ca does not in any event guarantee the customer ongoing service 100% of the time, but rather 99.9%.  ISG.ca will do everything in its power to ensure the smooth running of its service.  ISG.ca cannot be held responsible for any damage caused by the interruption of its service or by the speed of access to its service since many specifics of the Internet do not allow us to provide such a guarantee.

XX.      ISG.ca cannot be held responsible for any damage caused to data stored on its servers. This includes but is not limited to, loss of data, data corruption, performance failure and momentary interruption of service. It is the customer's responsibility to always keep a backup of the data stored on ISG.ca servers, elsewhere than on those servers.

XXI.          ISG.ca antivirus services can be enabled or disabled by the customer from the hosting management interface. ISG.ca antivirus services cannot remove viruses that already exist on the customer's computer.  Since it is impossible to detect and disinfect 100% of viruses due to several uncontrollable factors, and no system can claim to do so, ISG.ca offers no guarantee of effictiveness and cannot be held responsible for infections suffered by its customers. It is recommended that you always be alert and cautious when you receive and read e-mails.

XXII.        ISG.ca reserves the right to terminate any hosting contract without giving reasons. In this case, the customer ISG.ca shall refund the amounts paid in advance including the unused period of the current month.

XXIII.     The customer agrees to pay ISG.ca reasonable costs, including but not limited to, collection agency and attorney fees, incurred to apply its rights under these terms and conditions.

XXIV.      The customer agrees to indemnify ISG.ca if he violates any of the sections of these terms and conditions.

XXV.        ISG.ca reserves the right to change the hosting plans without notice. ISG.ca may remove, modify or add options to the current hosting plans without notice. If one or several of the options in his hosting plan are withdrawn or modified, the customer shall be entitled to terminate his hosting plan and receive a refund for the unused period, including for the current month (applies only if there is a withdrawal or modification).

XXVI.      ISG.ca may change the rates charged for the various hosting plans at any time without notice. Customers with a contract of 3 months or more will not be affected by changes in rates for the period already paid. For contracts of 3 months or more, the new rates shall apply upon renewal.

XXVII.      ISG.ca reserves the right to maintain different prices and offer different hosting plans to certain customers for a given period of time for any reason whatsoever. This shall in no way be construed as abandonment by ISG.ca of the rights and responsibilities described in these terms and conditions.

XXVIII.       ISG.ca reserves the right to modify these terms and conditions at any time without prior notice.

XXIX.      The customer accepts that the address for his website be used by ISG.ca for promotion and referral purposes to potential customers.

XXX.        Any complaints or misuse noted regarding ISG.ca servers should be sent to the following address:

XXXI.      The use of ISG.ca services confirms your acceptance of these terms and conditions at all times.

XXXII.      These terms and conditions are governed in accordance with the laws of the Province of Quebec.

XXXIII.       Any dispute concerning these terms and conditions shall be handled in Quebec under the laws of the Province of Quebec.

XXXIV.       All taxes applicable to the services provided by ISG.ca shall be added to the Internet hosting rates for residents of Quebec and Canada.
